ARTICLE 1. General Provisions

  1. These Terms and Conditions set out the rules for using the website available at https://dimark.eu/ (hereinafter referred to as the “Service”), operated by DIMARK joint-stock company (spółka akcyjna) with its registered office in Golęczewo (address: ul. Gottlieba Daimlera 17, 62-001 Golęczewo, Poland), entered in the Register of Entrepreneurs of the National Court Register under KRS number 0000852879 (registration court: District Court Poznań – Nowe Miasto and Wilda in Poznań, 8th Commercial Division of the National Court Register); NIP: 9721309844; REGON: 386660800; share capital: PLN 100,000.00 (one hundred thousand Polish zlotys).
  2. These Terms and Conditions specify the rules governing:
    1. the provision of electronic services by the Service Provider in accordance with the Act of 18 July 2002 on the provision of electronic services,
    2. the use of the Service and its available functionalities,
    3. the use of the contact form,
    4. the use of the “Resource Center” section of the Service,
    5. the liability of the Service Provider and the User,
    6. security rules related to the provision of electronic services.
  3. The Service serves an informational and presentation function. All content made available therein is of a general and informational nature only and does not constitute an offer or provision of paid services. DIMARK does not conclude contracts, conduct sales or provide paid services via the Service.
  4. Use of the Service constitutes acceptance of these Terms and Conditions.

ARTCLE 2. Definitions

For the purposes of these Terms and Conditions, the following definitions shall apply:

  1. Dimark – the term used in these Terms and Conditions to refer to Dimark S.A., the entity operating the Service.
  2. Contact Form – an electronic form available in the Service enabling Users to send inquiries to DIMARK.
  3. Access Form – an electronic form available in the Resource Center section, the completion of which enables access to selected materials made available by DIMARK.
  4. Dimark Group – a group of entities linked by capital and operations, consisting of Dimark S.A., Dimark IT S.A. and Dimark Manufacture S.A.
  5. Ethics Line – a mechanism enabling Users to report irregularities, internal violations or actions inconsistent with DIMARK’s values, either anonymously or with personal data, including the possibility of tracking the status of a report using an individual PIN number.
  6. Materials – all files, documents, graphics, instructions and content made available by DIMARK.
  7. Terms and Conditions – these Website Terms and Conditions of DIMARK.
  8. Resource Center – a section of the Service enabling the download of Materials after completion of the Access Form.
  9. Service – the website available at https://dimark.eu/, including all subpages, functionalities and materials published by DIMARK.
  10. User – any natural person, legal person or organizational unit using the Service.

ARTICLE 3. Use of the Service

  1. The Service Provider provides electronic services via the Service within the meaning of the Act of 18 July 2002 on the provision of electronic services.
  2. These services include in particular:
    1. making informational content available in the Service,
    2. enabling the use of the Contact Form,
    3. enabling the download of Materials via the Resource Center after completion of the Access Form.
  3. The User is obliged to:
    1. use the Service in accordance with the law, good practices and these Terms and Conditions,
    2. refrain from providing unlawful content,
    3. refrain from actions that may disrupt the functioning of the Service.
  4. The Service Provider may refuse to provide electronic services to a User who violates these Terms and Conditions or applicable laws.

ARTICLE 4. Technical Requirements

  1. Proper use of the Service requires meeting the minimum technical requirements, in particular:
    1. a device (computer, tablet, smartphone or other) with Internet access enabling comfortable use of the Service,
    2. an up-to-date version of a supported web browser (e.g. Google Chrome, Mozilla Firefox, Safari, Microsoft Edge) or another compatible browser supporting HTML5 and CSS3 standards,
    3. enabled SSL/TLS protocol support and JavaScript technology,
    4. no software blocking Service elements that could limit its functionality.
  2. The Service Provider recommends using the latest versions of operating systems and web browsers to ensure the highest level of security.
  3. The Service may use additional technologies, including analytical tools and browser cache mechanisms. Detailed rules regarding cookies are set out in the Privacy Policy, which is a separate document available in the Service.
  4. The Service Provider does not guarantee full compatibility of the Service with every device, hardware configuration or browser version. Use of devices or software that do not meet technical requirements may result in limited access to certain functionalities.
  5. The Service Provider shall not be liable for interruptions in the functioning of the Service caused by factors beyond its control, including in particular:
    1. failures of telecommunications infrastructure or Internet networks,
    2. power outages,
    3. hardware failures on the User’s side,
    4. actions or omissions of third parties, including network operators,
    5. force majeure.
  6. The Service Provider reserves the right to temporarily suspend the functioning of the Service or parts thereof in order to carry out maintenance, modernization or update works, if necessary for the proper functioning and security of the Service.

ARTICLE 5. Service Functionalities

  1. The Service enables Users in particular to:
    1. familiarize themselves with DIMARK’s activities and offerings,
    2. review descriptions of solutions and technologies,
    3. access multimedia and informational materials,
    4. use the Contact Form,
    5. use the Resource Center and download Materials after completing the Access Form.
  2. The Administrator may at any time:
    1. change the scope of functionalities,
    2. add or remove sections of the Service,
    3. update content published in the Service.

ARTICLE 6. Contact Form

  1. By using the Contact Form, the User may send an inquiry to the Administrator regarding DIMARK’s products, services or activities.
  2. In order to send an inquiry, the User is required to provide true and complete data in the following fields:
    1. region (Choose region),
    2. full name (Fullname),
    3. email address (Email),
    4. message content (Message).
  3. Dimark does not guarantee a response to every inquiry but makes reasonable efforts to respond within a reasonable time.
  4. Data provided in the Contact Form are processed in accordance with the rules set out in the Privacy Policy.
  5. The Ethics Line is a separate channel enabling secure and anonymous reporting of irregularities or internal violations. Each report submitted via the Ethics Line is treated confidentially, and the User receives an individual PIN number enabling monitoring of the report status and responding to follow-up questions.

ARTICLE 7. Resource Center

  1. Access to materials made available in the Resource Center is possible only after completing the Access Form and accepting the Terms and Conditions and the Privacy Policy.
  2. In the Access Form, the User provides in particular:
    1. full name,
    2. company name,
    3. position,
    4. email address,
    5. area of interest (Brownfield or Greenfield).
  3. The Administrator may refuse access without providing reasons, in particular in the event of doubts as to the accuracy of the data provided by the User.
  4. Materials made available to the User in the Resource Center are intended solely for informational, technical or business cooperation purposes with DIMARK and may not be shared or transferred to third parties without the Administrator’s consent.
  5. The Administrator may at any time revoke or limit the User’s access to the Resource Center if the User:
    1. violates these Terms and Conditions,
    2. provides false data,
    3. uses the Materials in a manner contrary to their purpose or DIMARK’s interests,
    4. poses a threat to the security of the Service.

ARTICLE 8. Liability and Security

  1. Dimark makes every effort to ensure that the content presented in the Service is up-to-date and accurate; however, it shall not be liable for:
    1. consequences of using the Service by Users,
    2. interruptions in availability or functioning of the Service,
    3. damage caused by actions of third parties or technical failures,
    4. data loss caused by Service failures,
    5. errors in presented content, which is of an informational nature only.
  2. It is prohibited for the User to provide unlawful content.
  3. The User shall be liable for damage resulting from:
    1. use of the Service in violation of the law,
    2. infringement of DIMARK’s copyrights or proprietary rights,
    3. provision of false data.
  4. The content is of an informational nature and does not constitute an offer within the meaning of the Civil Code.
  5. DIMARK shall not be liable for business decisions made based on information obtained from the Service.
  6. The User is obliged to use the Service in accordance with the law.
  7. It is prohibited to:
    1. attempt hacking activities,
    2. introduce malicious software,
    3. exploit technical vulnerabilities.
  8. DIMARK applies technical and organizational measures to ensure data security.

ARTICLE 9. Copyright and Licenses

  1. Content presented on the Service, including textual materials, graphics, photographs, technical and multimedia materials, is protected under the Act on Copyright and Related Rights.
  2. Any copying, modification, downloading, use or distribution of Materials requires DIMARK’s consent, unless expressly stated otherwise.
  3. A User using the Resource Center receives a non-exclusive, non-transferable license to use downloaded Materials solely for the purpose for which they were made available.
  4. Copying, sharing, distribution or use of any content requires DIMARK’s prior consent.

ARTICLE 10. Personal Data Processing

Rules regarding the protection of personal data are set out in the Privacy Policy, which constitutes a separate document available in the Service.

ARTICLE 11. Cookies

  1. The Service uses cookies and similar technologies in accordance with applicable law.
  2. Detailed information regarding the use of cookies, including their types, purposes, storage periods and rules for managing cookie settings by the User, is set out in the Privacy Policy, which is a separate document available in the Service.
  3. Use of the Service means that the User has read the rules regarding cookies set out in the Privacy Policy.

ARTICLE 12. Final Provisions

  1. In matters not regulated by these Terms and Conditions, the relevant provisions of Polish law shall apply.
  2. The Administrator reserves the right to amend these Terms and Conditions. Users will be informed of changes by publication of the new version on the Service.
  3. Amendments to the Terms and Conditions shall enter into force on the date of their publication, unless stated otherwise.
  4. The Terms and Conditions are available free of charge on the Service in a form enabling downloading, saving and printing.
  5. These Terms and Conditions are effective as of 8 March 2026, i.e. the date of their publication on the Service.
